TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

By accessing or using Offtape ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. DESCRIPTION OF SERVICE

Offtape is a private voice diary app. You record voice entries, which are transcribed and reflected upon using AI. The App stores your data in your account. Offtape is NOT a replacement for professional therapy, counselling, or medical advice.

3. IMPORTANT DISCLAIMERS

Not Therapy: Offtape is a journaling and reflection tool, not a mental health service. It does not provide diagnosis, treatment, or professional psychological services.

Emergency Services: If you are experiencing a mental health crisis, please contact emergency services immediately. In the EU, call 112. In the US, call 988 (Suicide & Crisis Lifeline) or text HOME to 741741.

No Guarantees: We make no guarantees about the effectiveness of the App for any particular purpose. Results vary by individual.

4. YOUR CONTENT

You own your voice recordings, transcripts, and reflections. We do not claim any rights to your content. Audio is processed by OpenAI Whisper for transcription and Anthropic Claude for reflection. These services process your data per their respective privacy policies but do not retain it for training.

5. USER ACCOUNTS

You may create an account using email or Google authentication. You are responsible for maintaining the security of your credentials. You must be at least 18 years old to use this App.

6. SUBSCRIPTIONS AND PAYMENTS

Free accounts are limited to 5 tapes per month. Offtape Pro removes this limit. Payments are processed through Stripe (web) or Apple In-App Purchase (iOS). Subscription management is handled by RevenueCat.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods. Refunds follow the applicable app store or payment processor policy.

7. ACCOUNT DELETION

You can delete your account and all associated data at any time from Settings. This action is irreversible and removes all entries, audio recordings, reflections, and personal data.

8. ACCEPTABLE USE

You agree not to misuse the App or help anyone else do so. You may not attempt to reverse engineer, decompile, or extract source code from the App.

9. INTELLECTUAL PROPERTY

All content, features, and functionality of the App are owned by Forward Systems GmbH and protected by intellectual property laws. You may not copy, modify, or distribute any part of the App without permission.

10. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Forward Systems GmbH shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Offtape is provided "as is."

11. CHANGES TO TERMS

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms.

12. GOVERNING LAW

These Terms are governed by the laws of Germany. Any disputes will be resolved in the courts of Berlin, Germany.
